No Compensation Agreed in Medical Malpractice Case

A man has spent over 21 years in a coma due to mistakes which were made during cosmetic surgery. While the family claims that this is due to medical malpractice, the insurance company has refused to offer any compensation to pay for treatment.

The family hired a Lawyer to handle the case. The lawyer helped the family to file a case against the hospital. The lawsuit is trying to get 1.65 million euros for the family. This amount is considered to be far too high by the insurance company who have declined to offer this much compensation.

The family is not pleased with the outcome of the insurance company’s decision. They are upset by the treatment they have received and feel that they were not treated fairly at the short hearing. The family mentioned that they will continue trying to fight to get compensation for the mistakes which were made.

The family has spent a long time trying to fight for compensation. They have been attempting to do this since mistakes were made during the operation. This has left their son in a troubled position where he is unable to move. He is in a coma which means he is in a vegetative state. The expert mentions that the family has not received any assistance towards the financial costs of caring for their son while in this condition.

The insurance company treated the family like criminals. The actually accused them of trying to commit fraud and extort money from the company. The father of the son was outraged by this and said that he was only doing everything possible to provide for his son.

The rep who has practiced in Staten Island and Westchester noted that if the insurance company and family are unable to reach a settlement then they will need to bring a new case before the Supreme Court. However, the original case saw the hospital cleared of negligence which meant the family had to pay €400,000 in legal bills for the case.

After a new witness has offered new evidence to the case, the Supreme Court will review the case. This witness says that the anesthetist left the room during surgery which was an obvious example of being negligent.

Woman dies after birth

A woman in Chennai has died after giving birth to a live baby. It is alleged that the death was caused by medical negligence. Two of the assistants helping with the birth are currently suspended according to hospital records.

The 26 year old patient was admitted to hospital on Thursday afternoon. She explained that she was suffering from serious labor pains and required painkillers to bring the main under control explains the study.

After being in the hospital for three hours, the woman gave birth to a baby. The baby weighed 2.5kg and was a boy. The baby was delivered normally and the placenta was removed and was checked to be intact. Although the baby and placenta were healthy, the mother was bleeding and continued to bleed for a long time.

The relatives of the deceased patients allege that there was not a doctor available to deal with the health concerns of the mother. They say that the maternity assistants were the only people who supervised the birth.

The hospital denies these allegations and claim that a doctor was in fact supervising the birth. Medical staff tried to get the bleeding under control. They first did this by trying to use medications, but after 7:30PM the decision was made to move her to another hospital.

When the patient was moved to the other hospital the bleeding continued. The doctors gave her an anesthetic and used stitches to try and stem the bleeding. However, before this could be proven to be effective the patient suffered a cardiac arrest. She died early on Friday morning as attempts to revive her failed.

The relatives of the patient have protested in front of the hospital accusing them of being negligent and not offering the correct standard of care says the report. The family also alleges that the medical staff was not supportive or patient with the delivery. Instead they are accused of using bad language when she had difficulty.

An investigation to the standard of health care is currently ongoing. The medical assistants are currently suspended while the investigation takes place.

Facelift turns Fatal

During a facelift at a local plastic surgeon's office an Irish woman fell to the ground, and upon arrival at the nearby hospital, was declared dead.

The woman had traveled from Limerick, Ireland, to have her facelift done. After the surgery, her doctors left the office, leaving the woman in the care of a nurse, who apparently did not know what to do when the woman collapsed. The nurse called 911 and the woman was declared dead at the hospital.

According to a New York Medical Malpractice Lawyer, fingers have been pointed in multiple directions since the surgery. The plastic surgeon did settle with the family for an undisclosed sum, but the family is also suing the nurse as well as the anesthesiologist who were also in the operating room. Both the nurse and anesthesiologist have pointed to the plastic surgeon as the one who was at fault.

The NY Medical Malpractice Lawyer has stated that the anesthesiologist was in a hurry to leave the office and did not complete his work appropriately, which was also a cause as to the woman's death. She died on St. Patrick's Day. in the Bronx and in Brooklyn, hospitals are always trying to prevent these mistakes.

A fatal facelift in Central Park

The family of Kay Cregan had filed a multi million-dollar lawsuit against Dr. Michael Sachs. Cregan had come to New York City in March 2005 to have a face-lift, nose job and chin augmentation. She had left Ireland and told her family she would be visiting friend in Dublin, but actually went to Dr. Sachs’s office in New York City. Her family and a NYC Medical Malpractice Lawyer brought a lawsuit in New York County Supreme Court against the plastic surgeon who performed the surgery, the anesthesiologist and the nurse. The suit alleges that after administering the anesthesia, the anesthesiologist did not stay to regulate Cregan’s blood pressure. After the surgery, Cregan’s blood pressure dropped and she passed out. The suit further alleges that the nurse failed to intubate Cregan or to call an ambulance in a timely manner. Dr. Sachs settled with Cregan’s family out of court for an undisclosed amount. The family is still suing the anesthesiologist and nurse. Sach’s medical license was taken away in 2008. Hospitals in New York and Brooklyn are susceptible to these suits.

Apologies Prevent Medical Lawsuits, Reports New York Medical Malpractice

A new Michigan State bill may help lessen the amount of medical malpractice lawsuits. This new measure would allow a doctor to say “I’m sorry” without it being an admission of guilt when procedures go wrong. A NYC Medical Malpractice Lawyer says that doctors see it as a step in the right direction.

A doctor with the Michigan State Medical Society has said that anything you say when dealing with patients and their families can be held against you. If you admit that you’re sorry that something has went wrong, many people see that as an implication of guilt, or that you did something wrong during the procedure. Currently these heartfelt apologies can be seen as admissions of guilt to a wrongdoing on the doctor’s part. Anesthesia errors can occur at any hospital and often do in Nassau, Long Island where a lawyer familiar with the law should be called.

According to a New York Medical Malpractice Lawyer, a new proposed bill states that saying “I’m Sorry” when something goes wrong would no longer be an admission of guilt. 35 states already have what are called “I’m Sorry” laws in place, and reports have shown that the number of medical malpractice lawsuits have decreased in a lot of those states.

The hope is that fewer lawsuits may eventually lead to lower insurance premiums as well. But first the Michigan State Medical Society just wants to help protect the health care workers and their families. Although this law would apply to all health care professionals, it would not apply to people who apologize and admit they’re guilty as well.
